Terms and Conditions (T&C) for the Online Shop of OpenRyu Shamisen, Andreas Tellenbach

§1 Scope

These Terms and Conditions (T&C) apply to all orders and deliveries between

(hereinafter "we" or "us"),

and our customers (hereinafter "customer" or "you") through our online shop (hereinafter "shop"). They apply to all orders placed in our shop and are valid for customers residing in Switzerland, Liechtenstein, the European Union (EU), and the rest of Europe.

§2 Conclusion of contract

The product presentation in our shop does not represent a legally binding offer but a non-binding online catalog.

By clicking the order button, you place a binding order for the goods in the shopping cart.

The purchase contract is concluded when we accept your order by an order confirmation via email.

§3 Prices and payment Terms

All prices are stated in Swiss Francs (CHF) and include the statutory value-added tax, where applicable.

Customers outside Switzerland should note that additional customs duties, taxes, and fees may apply upon import, which are not included in the prices.

We accept prepayment to our bank account in Switzerland as a payment method.

The purchase price is due immediately after the conclusion of the contract.

§4 Delivery and shipping

We deliver within Switzerland, to Liechtenstein, and to countries in the European Union (EU) and the rest of Europe.

Delivery times vary depending on the product and destination and are indicated on the respective product page.

If a product is unavailable, we will inform you immediately and refund the purchase price if payment has already been made.

For deliveries to EU countries, customs duties, import taxes, and similar charges may apply, which are the responsibility of the customer.

The stated delivery times are non-binding, as we have no influence over the processes of our shipping partners.

§5 Shipping costs

Shipping costs are displayed during the order process and are to be borne by the customer unless free shipping is offered.

§6 Retention of property

The goods remain our property until full payment of the purchase price has been received.

§7 Right of withdrawal

You have the right to withdraw from the purchase contract within 14 days without giving any reason.

The withdrawal period is 14 days from the day you or a third party designated by you received the goods.

To exercise your right of withdrawal, you must inform us of your decision to withdraw from the contract through a clear statement (e.g., by email).

§8 Returns

In the event of withdrawal, you must return the goods to us without delay and in any case no later than 14 days after declaring the withdrawal.

The cost of return shipping is borne by the customer unless the delivered goods are defective or not as ordered.  
We will refund the purchase price after receiving and inspecting the returned goods.

Please understand that we may only accept products specially ordered for you (both from our own and external suppliers), which show defects, were delivered incompletely, have damaged packaging, or show signs of use, with a processing fee or, in some cases, not at all.

§9 Warranty and liability

Statutory warranty rights apply.

We are only liable for damages caused by gross negligence or willful misconduct on our part. Liability for slight negligence is excluded to the extent permitted by law.

For goods damaged during transport abroad, the customer is liable unless an appropriate transport insurance policy has been taken out.

§10 Data privacy

Please refer to our Privacy policy.

§11 Applicable law and jurisdiction

Swiss law applies, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).

For customers residing in Switzerland or Liechtenstein, the exclusive place of jurisdiction is the seat of OpenRyu Shamisen, Andreas Tellenbach. For customers from the EU, the European Commission provides a platform for online dispute resolution (ODR). Our email address is: hello@openryu.ch.

§12 Final provisions

Should individual provisions of these T&C be invalid or become invalid, the validity of the remaining provisions shall not be affected.
